Understanding Mediation Requirements In England In 2026

If you are separating or divorcing and are considering court action relating to children or finances, you may have been told you need to attend a MIAM. 


But what is a MIAM? 


What Does MIAM Stand For? 

MIAM stands for Mediation Information and Assessment Meeting. 

It is not joint mediation. 


Why Is a MIAM Required? 

Under the Family Procedure Rules, most applicants to the Family Court must attend a MIAM before issuing proceedings. 


The aim is to ensure families understand alternatives to litigation. 


What Happens At A MIAM? 

During the meeting, you will: 

  • Learn how mediation works

  • Discuss your situation

  • Explore suitability

  • Raise any safeguarding concerns 

This meeting typically lasts 45-60 minutes. 


Is the MIAM Meeting Confidential? 

Yes. Everything discussed is confidential, subject to limited safeguarding and legal exceptions. 


Do I Have To Continue With Mediation? 

No. You are only required to attend the MIAM. 

If mediation is unsuitable or you choose not to proceed, the mediator can sign the relevant court form, and explain about other forms of NCDR (Non-Court Dispute Resolution). 


When Is A MIAM Not Required? 

In some cases, exemptions may apply, including: 

  • Domestic abuse

  • Child protection concerns

  • Previous recent MIAM attendance

Why MIAMs Can Be Helpful 

Even when mediation does not proceed, many people find that: 

  • They better understand their options

  • They feel more informed before court

  • They feel calmer about next steps 


Think of the MIAM as a first step to mediation, one that will give you an opportunity to make an informed decision about your separation and ask the questions you need to in a mediated environment.
